Bay View Training provides access to its network, and its connection to the Internet, for lawful purposes only. Any use that violates applicable Federal, state, or local laws using Bay View Training's facilities is prohibited, and will result in immediate termination of access. Such facilities include but are not limited to electronic mail, Web pages, storage of files on Bay View Training's disks, or any other computer use that violates the law.

The use of Bay View Training's facilities to transmit unsolicited commercial e-mail or Usenet postings ("spam") to any address either inside or outside of Bay View Training's network, whether or not through the use of bulk remailer software, is prohibited, and will result in immediate termination of access.

You agree that violation of these rules may result in you being held liable for any expenses that Bay View Training may occur as a result of your actions which violate these rules, and that you will not hold Bay View Training liable for any harm you may suffer as a result of such actions.


Unsolicited Commercial E-mail

Bay View Training does not engage in or tolerate "spam." Unsolicited commercial or pornographic email sent to any bayview.com address, or to any other domain owned by Bay View Training, is illegal according to Federal and California State laws, and we reserve the right to fully prosecute any offenders according to those laws.

Pursuant to the California Business & Professions Code §17538.45, notice is hereby given that the e-mail servers belonging to Bay View Training are located in the state of California, and that the use of such servers for Unsolicited Commercial E-mail (UCE) is strictly prohibited. Persons, companies, or organizations sending UCE to or from any address or domain hosted by Bay View Training are hereby notified that such UCE is not permitted, and if such UCE were sent to an e-mail address or domain hosted by Bay View Training, or sent by a customer of Bay View Training using our servers, it would be in violation of our policy, and subject to civil action under California law.

Pursuant to the California Business & Professions Code §17538.4, any unsolicited commercial e-mail (UCE) sent to any e-mail server owned by an e-mail service provider (ESP) with equipment located in the state of California must include "ADV:" as the first four characters of the subject line, or "ADV:ADLT:" as the first nine if it is of an adult nature. Also, each such message must contain a toll-free number which recipients may call to be removed from the sender's mailing list. Violations of this statute are punishable as a misdemeanor.

Also, according to California Penal Code §502, it is a crime under California law to use another party's Internet domain name in connection with the sending of electronic mail messages. In other words, if the domain bayview.com, or any of the domains hosted by Bay View Training, are used by any unauthorized persons as the "From:" address of e-mail messages, we may seek criminal charges against such persons.
